1. OUR SERVICES
Our Services include a wellbeing application designed to assist users in reducing pain and increasing movement through computer vision technology, pose estimation, and associated exercise recommendations.
By using the Services, you agree that you are solely responsible for compliance with any laws and regulations that apply to you. The Services are not tailored to comply with specific industry regulations, including but not limited to the Health and Safety at Work Act 1974 or any other applicable regulatory frameworks.
2. INTELLECTUAL PROPERTY RIGHTS
We own the intellectual property rights in our Services, including all content, designs, features, and functionality (collectively, "Content"). All Content is protected by intellectual property laws. Informal Negotiations: To expedite resolution and control the cost of any dispute, we encourage you to first attempt to negotiate any dispute informally. Informal negotiations will commence upon written notice from one party to the other.
Binding Arbitration: If any dispute cannot be resolved through informal negotiation, it shall be resolved by binding arbitration in accordance with the rules of the UK Arbitration Act 1996. The arbitration shall be conducted by a single arbitrator appointed in accordance with those rules. The arbitration will be held in London, England, unless the parties agree otherwise.
You hereby consent to the jurisdiction of the courts of England and Wales. If you prefer to resolve your disputes in court rather than arbitration, you may do so in the courts of England or Wales. You retain the right to seek injunctive relief in the courts of England and Wales as necessary.
17. CORRECTIONS
There may be information on our Website that contains typographical errors, inaccuracies, or omissions, including descriptions, prices, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update the information at any time without prior notice.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE OR THAT ANY DEFECTS WILL BE CORRECTED.
19. LIMITATIONS OF LIABILITY
IN NO EVENT WILL WE OR OUR DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOST PROFITS, DATA, OR OTHER DAMAGES ARISING FROM YOUR USE OF OUR SERVICES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, OUR LIABILITY TO YOU FOR ANY CAUSE WILL AT ALL TIMES BE LIMITED TO THE AMOUNT YOU PAID, IF ANY, TO US DURING THE SIX (6) MONTH PERIOD PRIOR TO ANY CAUSE OF ACTION ARISING.
20. INDEMNIFICATION
You agree to defend, indemnify, and hold harmless HumanBalance.ai, its affiliates, and their respective officers, agents, and employees from and against any claims, damages, liabilities, losses, or expenses, including reasonable legal fees, arising out of or in connection with your use of the Services, any Contributions you provide, or your violation of these Terms.
21. USER DATA
We will maintain certain data that you transmit to the Services for the purpose of managing the performance of the Services, as well as data related to your use of the Services. Although we perform regular routine backups of data, you are solely responsible for all data that you transmit or that relates to any activity you have undertaken using the Services.
22. ELECTRONIC COMMUNICATIONS, TRANSACTIONS, AND SIGNATURES
You consent to receive electronic communications from us. You agree that all agreements, notices, disclosures, and other communications provided to you electronically will satisfy any legal requirement that such communications be in writing.
23. MISCELLANEOUS
These Terms and our Privacy Policy constitute the entire agreement between you and HumanBalance.ai regarding your use of the Services. Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is found to be unlawful, void, or unenforceable, the remaining provisions will still apply.
